By enrolling, logging in, accessing, or participating in the Course, you ("you", "Learner") agree to these Terms & Conditions ("Terms").

1. Definitions

Course: the online training programme described on our website/enrolment page, including any live sessions, recordings, written materials, assessments, and community areas.

Platform: the learning management system ("LMS") and any third-party tools used to deliver the Course.

Content: all Course materials, including videos, slides, handouts, quizzes, worksheets, and resources.

Consumer: an individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.

2. Course purpose, scope, and professional boundary

2.1 Educational purpose only. The Course provides education and skills training and is not a regulated healthcare service.

2.2 No clinical advice; no therapy; no counselling relationship. The Course (including any Q&A, feedback, or tutor interaction) does not:

constitute medical, psychiatric, psychological, or clinical advice;

provide diagnosis, treatment, crisis intervention, or psychotherapy; or

create a therapist–client or counsellor–client relationship between you and us (or any tutor).

2.3 Not a substitute for professional support. If you require personal bereavement counselling, psychotherapy, medical care, or crisis support, you should seek appropriate qualified services.

3. Mental health protection and suitability (important)

Because bereavement-related content can be emotionally activating, you agree to the following.

3.1 Self-assessment of suitability. You confirm you are currently able to engage with potentially distressing material (including discussion of death, grief reactions, trauma responses, and loss narratives).

3.2 Pause/withdraw. You may pause participation at any time. If you feel overwhelmed, you should stop the session, use grounding strategies, and seek support.

3.3 Not for emergencies. The Course is not designed for urgent mental health needs. If you are at immediate risk of harm, call emergency services. In the UK, you can seek urgent NHS mental health help via NHS guidance and services.

3.4 Signposting (UK). For urgent emotional support, Samaritans can be contacted (UK).

3.5 Disclosures and safeguarding. If, during live interaction, you disclose information indicating a serious risk of harm to you or others, we may (where reasonably necessary) take steps such as:

encouraging you to contact emergency/clinical services immediately; and/or

limiting or ending the interaction to protect welfare; and/or

reporting concerns where legally required.

We do not guarantee continuous monitoring of learner communications.

4. Eligibility, prerequisites, and learner responsibilities

4.1 Minimum age. You must be at least 18 years old (or older if required by local law).

4.2 Prerequisites. Any prerequisites stated on the course page are mandatory. You are responsible for ensuring you meet them.

4.3 Fitness to practise / ethical use. You agree to use Course learning ethically and within the limits of your competence and professional scope, and to comply with applicable professional codes if you are a practising professional.

5. Enrolment, accounts, and access

5.1 Account security. You are responsible for maintaining confidentiality of your login credentials and all activity on your account.

5.2 Single-user licence. Unless expressly agreed otherwise, enrolment grants access for one named learner only. Account sharing is prohibited.

5.3 Access term. Your access begins on the date of your registration and continues for 3 days.

6. Live sessions, recordings, and participation rules

6.1 Live sessions. Dates/times are published on the Platform and may be adjusted with reasonable notice.

6.2 Recordings. Live sessions may be recorded for quality and learner access. If you do not wish to be recorded, do not speak/enable camera, or use chat anonymously where available (subject to platform capability).

6.3 Community conduct. You agree not to:

harass, shame, or target others;

share hate content, explicit content, or illegal content;

post identifying details of third parties (including the deceased) without lawful basis and consent where required;

present personal stories of other learners outside the Course environment.

We may remove content and/or suspend access for breaches.

7. Confidentiality and sensitive content

7.1 Learner confidentiality expectation. Discussions may include personal experiences. You agree to treat other learners’ disclosures as confidential.

7.2 No absolute confidentiality. Online environments cannot be guaranteed secure. You should not share anything you would not want disclosed.

7.3 Your responsibility for what you share. You remain responsible for any personal or third-party data you disclose.

8. Fees, payment, and taxes

8.1 Fees. Prices are shown at checkout and include/exclude VAT as stated.

8.2 Payment processing. Payments are handled via [Processor]. Your payment details are processed under the processor’s terms.

8.3 Non-payment. We may suspend access if payment is reversed, chargebacked, or overdue.

9. Consumer right to cancel and refunds (UK)

This section applies if you are a Consumer purchasing online.

9.1 14-day cooling-off right (default). You typically have 14 days to cancel from the day after purchase (subject to the rules below for digital content).

9.2 Immediate access and digital-content cancellation exception. If you choose to receive immediate access to the Course (digital content/service), you acknowledge that you may lose the right to cancel once access/delivery begins if:

you have been clearly informed of this; and

you provide express consent and acknowledgement at checkout.

9.3 How to cancel. To cancel, email alexjames@bereavement.co.uk with subject line "Cancellation – Human Aspects Bereavement Course".

9.4 Refunds. Where a refund is due, we will refund using the original payment method within a reasonable time and in accordance with applicable rules.

9.5 Business learners. If you purchase as a business (non-consumer), cancellation rights are as stated on the order/contract and may differ.

10. Course changes, updates, and availability

10.1 Updates. We may update Content to maintain quality, accuracy, or alignment with best practice.

10.2 Material changes. If we make material changes that significantly reduce value, we will provide an appropriate remedy (e.g., extended access, replacement module, or partial refund), depending on circumstances.

10.3 Platform downtime. We do not guarantee uninterrupted access; we will use reasonable efforts to restore service.

11. Assessments, certificates, and results

11.1 Assessment rules. Passing criteria (if any) are shown on the Platform.

11.2 Certificates. Certificates confirm completion/attendance only and do not confer a professional qualification unless explicitly stated.

11.3 No outcome guarantee. We do not guarantee employment, client outcomes, or professional accreditation acceptance.

12. Intellectual property and permitted use

12.1 Ownership. All Content is owned by us or our licensors.

12.2 Licence. You receive a limited, non-transferable, non-exclusive licence to access the Content for your personal learning (or internal organisational training if purchased for that purpose).

12.3 Restrictions. You must not copy, redistribute, sell, sublicense, scrape, or create derivative works from the Content, except where explicitly permitted in writing.

13. Data protection and privacy

13.1 Privacy notice. We do not hold any personal data. Your registration data is confined to just your user name, password, date of registration, your device ID and unique PayPal transaction ID, which are all stored locally in a browser cookie which is automatically deleted at the end of the 3 day duration of the course.

13.2 UK GDPR/ICO alignment. We aim to follow UK data protection requirements and ICO guidance relevant to organisations.

13.3 Special category data. If you share health-related information in discussions, it may constitute special category data. You should avoid posting sensitive personal data in community areas.

14. Disclaimers specific to bereavement-related learning

14.1 Content sensitivity. Course materials may discuss distressing topics. You accept this risk and agree to use appropriate self-care.

14.2 Third-party resources. Any external resources are provided for convenience. We do not control or endorse third-party content.

14.3 Professional judgement. If you apply Course learning in practice, you remain solely responsible for your professional decisions and for operating within your competence and legal scope.

15. Limitation of liability

15.1 Nothing excluded that cannot be excluded. We do not exclude or restrict liability where it would be unlawful to do so, including (for consumers) liability for death or personal injury caused by negligence.

15.2 No liability for indirect loss. To the extent permitted by law, we are not liable for indirect or consequential losses (e.g., loss of profit, revenue, goodwill, opportunity).

15.3 Cap (business-to-business). If you are not a Consumer, our aggregate liability is capped at 100% of fees paid for access to the training course, except for liabilities that cannot be limited by law.

15.4 Technology and connectivity. We are not liable for losses caused by your device, software, settings, or internet connectivity.

16. Termination and suspension

16.1 By you. You may stop using the Course at any time (refunds are governed by Section 9).

16.2 By us (for cause). We may suspend or terminate access if you breach these Terms, including misconduct, account sharing, IP infringement, or abusive behaviour.

16.3 Effect of termination. On termination, your licence to access Content ends immediately.

17. Complaints and contact

17.1 Support. Contact alexjames@bereavement.co.uk. We aim to respond within 3 business days.

17.2 Complaints procedure. If unresolved, escalate by mail to Customer Services, BereavementUK Limited, 16977062, of 128 City Road, London, United Kingdom, EC1V 2NX. We may offer mediation where appropriate.

18. General legal terms

18.1 Entire agreement. These Terms (and documents referenced) form the entire agreement.

18.2 Severability. If any term is invalid, the rest remains effective.

18.3 Assignment. You may not assign your rights; we may assign as part of corporate reorganisation or sale.

18.4 Governing law and jurisdiction. These Terms are governed by the laws of England and Wales, and courts there have exclusive jurisdiction (unless mandatory consumer rules apply elsewhere).

It is training/education only and is not a clinical service, therapy, or bereavement counselling.
